Terms of Service

These are the terms for using Pemberton (the “Software”), sold by Zackariah Spooner (“we”, “us”). By installing or using the Software you agree to these terms. If you do not agree, get a refund (see Section 5).
1. What You Get
For a one-time payment of $4.99 USD, you receive:
- A perpetual license to install and use Pemberton on every Mac you personally own or use.
- All future updates to v1.x of the Software, at no additional charge.
- A 30-day no-questions-asked refund window (see Section 5).
- Email support at zackariah_spooner@alumni.brown.edu for as long as we are operating.
The license is for the binary and skill files we deliver. The helper package source code is separately licensed under the MIT License (see the LICENSE file in the npm package).
2. What You Need
Pemberton requires:
- macOS 14 or later
- Claude Code CLI installed and authenticated
- A Claude Pro, Max, Team, or Enterprise subscription (because Claude Code’s Haiku subagent dispatch bills against your subscription quota)
- Node.js 20 or later for the helper package
If you do not have these, the Software will not work and you should request a refund.
3. What You Can Do With It
Use it. Modify it. Read the source. Run it on personal machines. Share it with people on the same Mac.
You may not:
- Resell the Software or sublicense it to third parties.
- Distribute copies to people who have not paid (for v1 we ship via download link tied to your email; sharing the link is fine for personal backup but distributing it publicly is not).
- Misrepresent the Software as your own work.
- Use the Software to violate Anthropic’s terms of service for the Claude API. (You are responsible for your own Anthropic account; we are not.)
4. AI Output Disclaimer
Pemberton extracts entities and facts from your data using Claude Haiku. The output is generated by a probabilistic AI model and may contain errors, hallucinations, or outdated information. You are responsible for reviewing what Pemberton writes to your wiki and your CLAUDE.md before relying on it. Your wiki is plain markdown — edit it freely, and re-run /wiki-build whenever you want to refresh.
We are not liable for any decision you make on the basis of AI output, your own or otherwise.
5. Refunds
For 30 days after purchase, email zackariah_spooner@alumni.brown.edu and we will refund the full $4.99. No reason required. We may ask for context to improve the product, but you do not have to provide it.
After 30 days, refunds are at our discretion. We default to “yes” for cases where the Software does not work as advertised; we default to “no” for “I changed my mind.”
Refunds are processed by our payment processor and typically appear in 3-10 business days depending on your card issuer.
6. Warranty
The Software is provided “as is.” We do our best to ship working code. We test it. But we make no warranty that it is bug-free, fits any particular purpose, or will continue to work if Anthropic, Apple, or any other third party changes their software in a way that breaks ours.
The maximum liability we have to you for any claim arising from the Software is the amount you paid us, which is $4.99. (This is not legal hardball; it is honesty about the price-vs-risk math at $4.99.)
7. Discontinuation
If we stop operating Pemberton, we will:
- Push a final v1.x release that works without any server we run.
- Open-source the entire codebase under the MIT License at https://github.com/zspooner/pemberton.
- Email opted-in customers a heads-up.
You will keep your license, your wiki, and the right to fork the code. We do not strand you.
8. Privacy
See the Privacy Policy. Short version: we do not have a server, we do not collect data, we do not see your wiki.
9. Governing Law
These terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of that jurisdiction. If you are an EU consumer, your local consumer-protection rights apply where stronger than these terms.
